Terms and Conditions

1.    Premises 

Cosmoprof/Cosmopack Awards, hereinafter the “Award”, is a competition organized by BolognaFiere Cosmoprof S.p.A., with registered office in Bologna, via Maserati 16, P.iva 04717230967, hereinafter “BFC”. The Award is finalized to reward the companies exhibiting at the event “Cosmoprof Worldwide Bologna”, the “Exhibition”, which applied to the Award and distinguished their selves in the beauty sector for their products and/or raw materials. 
Cosmotrends, hereinafter "Cosmotrends", is a BFC’s project aimed at selecting the most innovative products among those presented by the exhibiting companies of the Exhibition and to draft the report of the Exhibition’s trends, hereinafter the "Trend Report". 
The applicant companies to the Award, hereinafter the "Participants", are automatically and inseparably candidates also for Cosmotrends with the same products, at no additional cost to the Participants.
Participants can submit their application form for the Award and Cosmotrends and present in a unique form their products on the following online platform made available by BFC: _www.cosmoprofawards.com_ hereinafter the “Platform”.   
BFC, in collaboration with Beautystreams INC, appoints the jurors in charge of examine and vote the Participants and their products submitted for the Award, hereinafter the “Jurors”, choosing them among renowned journalists, entrepreneurs and experts of the beauty sector.
By filing the application to the Award and to Cosmotrends Participants accept the present general terms and conditions of participation, hereinafter “T&C”.

2.    Correlation between the Award and Cosmotrends and modalities and requirements for application 

2.1    The Participants, are automatically and inseparably candidates also for Cosmotrends with the same products, at no additional cost to the Participants.
2.2    It is not possible for the Participants to separate their participation in the Award from their participation in Cosmotrends and it is not possible to present different products for the Award’s application with respect to the Cosmotrends’ application.
2.3    The Award’s application does not imply the automatic mention in the Trend Report and, likewise, the mention in the Trend Report does not imply the automatic selection as finalist and/or winner of the Award.
1.1    In order to take part in the Award and Cosmotrends, Participants shall fill the on line application form on the Platform. Please submit one form for Cosmoprof Awards and Cosmotrends and/or one form for Cosmopack Awards and Cosmotrends. Products’ entries shall regard maximum 2 (two) products per category, for a maximum of 34 (thirty four) products in all either for the participation in the Award either for the participation in Cosmotrends; products shall constitute a new launch, meaning products launched in the period between April 2024 and March 2025 and available for examination in case they are selected as finalists for the Award.
2.4    Application forms can be submitted starting from December, 10th, 2024 and shall be sent within and not later than 18:00 CET (Italian time) of February, 12th, 2025.
2.5    Application forms shall be submitted in English only under penalty of inadmissibility of the forms. In the event that BFC receives the application form in a language other than English, the application shall not be considered and, in any case, the application fee shall not be refunded.
2.6    In order to take part in the Award and Cosmotrends, Participants shall pay to BFC the application fee equal to Euro 350,00 (Euro 350,00 for Cosmoprof Awards and Cosmotrends and Euro 350,00 for Cosmopack Awards and Cosmotrends) while submitting the application form, following the instructions given by BFC. BFC reserves the right to ban a Participant from the Award and the Cosmotrends in the event it ascertains the omission of the payment of the application fee or the omission of the payment of the exhibiting fee to attend the Exhibition. The conclusion of the contract for participation in the Award and Cosmotrends takes place through the acceptance of these T&C and the payment service of the participation fee is provided by Archimedia S.r.l., which processes the payment service as a supplier in the name and on behalf by BFC. BFC is not responsible nor liable for the provision of the payment service rendered by Archimedia S.r.l. and is not liable for breaches directly attributable to Archimedia S.r.l.
2.7    To ensure the highest possible score, application form shall be completed in full, including only information that is relevant to the interested Award and Cosmotrends’s category in order to enable Jurors to assess its content in relation to the Awards and enable Beautystreams INC. to assess it in relation to Cosmotrends. BFC reserves the right to reject applications, which, at its sole discretion and unquestionable judgment, are not in line with the format of the Award and/or Cosmotrends.
2.8    BFC reserves the right, after consultation with the Participant, to modify the "Category" section of the completed application form if not appropriate.
2.9    An entry to an award category cannot be withdrawn from the judging process once the Participant has been short-listed and announced as a finalist of the Award and/or shortlisted for Cosmotrends.
2.10    Participants are required (as the case maybe) to provide additional product information and copies of supporting documents upon the request of BFC.

3.    Submission of samples

3.1    Participants whose products have been selected by Beautystreams INC and the Jurors as finalists of the Award are required to send to BFC at their own care, expense and risk n. 7 (seven) samples of each product presented in the application form and any information requested within and not later than March, 17th, 2025 morning time, to the address indicated by BFC. BFC declines any and all liability in case of deterioration, damage or alteration of the samples during transport to the place of delivery indicated by BFC or during the unpacking and installation of the samples at the Exhibition. 
3.2    All Participants in the "fragrances: personal & home" category, in order to be examined for the Award, shall in any case send the candidate samples for the said category to Beautystreams INC (samples, not products otherwise they will be blocked at customs), at their own care and expense, according to the modalities and the timing indicated by BFC.
3.3    In case of failure to send the above-mentioned samples within the terms referred to in article 3.1 and article 3.2 above, the application of the Participant and / or the entry of the single product cannot be taken into consideration by Jurors.
3.4    All submitted materials, including samples, will not be returned to Participants.

4.    Undertakings of Participants

4.1    Participants are required to describe in detail the products presented to the Award and the Cosmotrends in the application form, taking care to provide accurate and truthful information. Product presentations are visible exclusively by BFC, da Beautystreams INC and the Jurors and are examined in a completely confidential manner.
4.2    In case of selection of the Participant as finalist and/or winner of the Award the content of the application form of those Participants selected as finalists and/or winners of the Award will be published on the Award’s website. 
4.3    BFC cannot be held liable in any way except for the contents developed by the BFC’s employees.
4.3 By accepting these T&C, the Participants undertake to:

i.    not use the Platform to carry out marketing actions, not even using the profile of other users;
ii.    not send and / or insert viruses or other harmful codes into the Platform, not access the Platform in any other way using automated tools without the authorization of BFC, not take actions that could prevent, overload or compromise the correct functioning of the Platform;
iii.    not use the Platform to degrade, intimidate, or harass other Participants and/or the Jurors and/or Beautystreams INC.;
iv.    not to send and / or upload into the Platform contents that have a pornographic nature and / or characteristics and / or significance of incitement to hatred and violence, of praising discrimination of any kind (racial, religious, sexual, etc.), nude images or graphics or containing gratuitous violence;
v.    not use the Platform for illegal, deceptive or discriminatory purposes;
vi.    not send and / or upload any content that is defamatory towards BFC, BFC staff, other Participants, the Jurors or other third parties on the Platform;
vii.    not to use copyright, registered trademarks or logos of BFC or similar symbols that could mislead the Jurors and/or Beautystreams INC.;
viii.    not use third party copyrights, trademarks, logos or similar symbols in a way that creates confusion as to the rightful owner or user;
ix.    not use the Platform to carry out actions that might infringe the rights of third parties or otherwise breach the applicable law;
x.    not collect Participants' content or information or personal data, by any means, nor try to obtain log in credentials nor access the account profiles of other Participants;
xi.    not send and / or upload personal and / or third party identity documents or personal or sensitive data on the Platform.

5.    Rights and faculties of BFC

5.1    BFC reserves the right, at its sole and unchallengeable discretion, to ban with immediate effect from the Award and Cosmotrends any Participant in case of:

a)    wrong filling of the Award and Cosmotrends’ application form for whatsoever reason (including in case of provision of false or inaccurate information); 
b)    ascertained or suspected infringement of third party rights including intellectual property rights and copyrights;
c)    disparaging behavior or corruption towards the Jurors and/or BFC’s personnel and/or Beautystreams INC;
d)    any dispute and/or claim pertaining to the products and/or to the contents presented by Participants to the Award and Cosmotrends.

5.2    In the event that the infringement and / or illicit behavior of a Participant should result in actions or claims by third parties also involving BFC, the Participant in question shall indemnify and hold BFC harmless from any and all direct or indirect damages, loss or expense (including disbursements and legal fees) connected with or deriving from the aforementioned breaches or tort of the Participant and BFC shall withhold the participation fee paid by the Participant by way of penalty.

6.    Timing of the Award and Cosmotrends

After the submission of application forms for the Award and Cosmotrends, the finalists of the Award will be chosen within February, 28th, 2025. BFC shall announce the names of the Award’s finalists at BFC’s website (www.cosmoprof.it) and at the dedicated website (www.cosmoprofawards.com). The Award’s finalists will be notified by BFC by email. 
The Participants shortlisted for the Trend Report will receive an email notification from BFC.
The Award’s finalists, up to 4 (four) guests per each finalist, are invited to the Award winners ceremony that will take place at the Exhibition on March, 21st, 2025. Participants who are not finalists, up to 2 (two) guests per non-finalist, are invited to the Award winners Ceremony.
BFC reserves the discretional and undisputable right to modify the timing of the performance of the Award and Cosmotrends. The Participants shall visit the BFC’s website to be updated about the said timing. 

7.    Awarding of the Award’s winners

7.1. The Award’s winners will be announced on March, 21st, 2025 at the Exhibition’s service center.
7.2. The Award’s winners will receive the Award’s trophy and will benefit from the promotional activities carried on by BFC to promote the Award, the Award’s winners and the Exhibition.

8.    Decisions of the Jurors for the Award and Beautystreams’ decision for Cosmotrends 

8.1    Jurors and Beautystreams INC. are entitled to consider each product’s entry apart from the category criteria and at their own discretion based on their relevant experience and expertise.
8.2    Jurors and Beautystreams INC.’s decisions are final and binding and no objections nor demands will be accepted relating to any of their decisions regarding the Award, Cosmotrends and the Trend Report. 
8.3    BFC is not liable for any costs or liabilities incurred by Participants during the Award and/or Cosmotrends.
8.4    Any Participant who, in the opinion of the Jurors or BFC or Beautystreams INC., is perceived to have harassed or bribed any Juror and/or Beautystreams INC. shall be immediately banned from the Award and Cosmotrends.

9.    Trademarks of  BFC, Award’s Logo and Cosmotrends’ Logo

9.1    The participation to the Award and Cosmotrends and these T&C do not provide nor imply the assignment nor the license or sub-license of use to the Participants of the intellectual property rights and/or copyrights of BFC and, therefore, do not constitute an assignment nor a license to use any of the trademarks, logos, models or images of BFC and / or relating to the Exhibition.
9.2    Without prejudice to the above paragraph, BFC grants only to the Participants who have been proclaimed as winners and/or finalists in their category, the use of the Award logo, hereinafter the "Award Logo", and grants to the Participants shortlisted for the Trend Report the use of the Cosmotrends’ logo, hereinafter the “Cosmotrends Logo”. In particular, BFC grants the Participant who has been proclaimed finalist and/or winner of the Award and the Participant shortlisted for the Trend Report the worldwide license, free of charge, non-exclusive, non-assignable or sub-licensable (unless expressly authorized by BFC) of the Award Logo and the Cosmotrends Logo and related intellectual property rights for a period of 3 (three) years starting from the announcement as winner and/or finalist and shortlisted for the Trend Report.
9.3    The license for the use of the Award Logo and the Cosmotrends Logo, referred to in the previous paragraph, is granted to the Participant, who has been proclaimed finalist and/or winner of the Award and/or has been shortlisted for the Trend Report, exclusively for the following authorized purposes to be deemed as mandatory, collectively the "Authorized Purposes": 

a)    The reproduction of the Award Logo and the Cosmotrends Logo on promotional materials (in digital or printed format) relating to the product thanks to which the Participant has been proclaimed the winner and/or finalist and/or shortlisted for the Trend Report of his/her category of the Award, hereinafter the "Product";
b)    The use of the Award Logo and the Cosmotrends Logo on the means of communication (including social profiles) of the Participant or third parties authorized by the Participant only in the content related to the Product;
c)    The reproduction of the Award Logo and the Cosmotrends Logo on the labels and in the packaging of the Product;
d)    The use of the Award Logo and the Cosmotrends Logo in visual or printed advertising relating to the Product;
e)    The reproduction of the Award Logo and the Cosmotrends Logo in the Participant's exhibition stands, billboards and banners, provided that there is a clear and explicit reference to the Product.

9.4    The use of the Award Logo and the Cosmotrends Logo by the Participant proclaimed finalist and/or winner of the Award and/or shortlisted for the Trend Report for the Authorized Purposes shall always be done in the following modalities, hereinafter the "Modalities": the Participant shall always faithfully reproduce the digital seal of the Award Logo and the Cosmotrends Logo, as provided by BFC, without making any modification or alteration of any kind. 
9.5    It is also forbidden for the Participant to use, register or file any co-branded trademark containing the Award Logo and/or the Cosmotrends Logo or other distinctive symbol identical or confusingly similar to the Award Logo and the Cosmotrends Logo.
9.6    BFC warrants to the Participant, who has been proclaimed finalist and/or winner of the Award and/or shortlisted for the Trend Report, that it is the legitimate owner, or licensee, of the Award Logo and the Cosmotrends Logo and of the intellectual property rights pertaining to it and that the use of the Award Logo and the Cosmotrends Logo by the Participant for the Authorized Purposes and according to the Modalities referred to in paragraph 9.4. above does not infringe the rights of third parties. 
9.7    Without prejudice to the provisions of the preceding paragraphs, nothing in this T&C transfers or assigns to the Participant the Award Logo and the Cosmotrends Logo or any of the intellectual property rights on them. BFC therefore retains full and exclusive property of the Award Logo and the Cosmotrends Logo and the related intellectual property rights.
9.8    In order to allow BFC to monitor the use that the Participant does of the Award Logo and the Cosmotrends Logo and the related intellectual property rights, the Participant shall use all reasonable endeavors to share with BFC the advertisements relating to the Product. In addition, the Participant shall use all reasonable endeavors to tag the Exhibition in social and digital content whenever the Award Logo and the Cosmotrends Logo appear on such content, using the tags that will be communicated by BFC.
9.9    BFC cannot be held liable in any way for any damage caused to third parties: i) by the use made by the Participant of the Award Logo and the Cosmotrends Logo and the related intellectual property rights; and ii) the use made by the Participant of the Award Logo and the Cosmotrends Logo and the related intellectual property rights in breach of the Authorized Purposes and the Modalities referred to in the previous paragraphs.
9.10    The license to use the Award Logo and the Cosmotrends Logo referred to in this article 9 shall automatically terminate in the event that the Product is in any way updated and/or improved and/or altered and/or incorporated into other and different complementary products.
9.11    BFC has the right to terminate this licence by written notice to the Participant pursuant to article 1456 of the Civil Code, and therefore require the Participant to immediately stop any use of the Award Logo and the Cosmotrends Logo in the event of a breach by the Participant of this article 9. BFC is also entitled to terminate this licence, by written notice to the Participant pursuant to art. 1456 of the Italian Civil Code, and therefore require the Participant to immediately cease any use of the Award Logo and the Cosmotrends Logo in the event that BFC believes, at its own discretion, that there has been a breach of its intellectual property rights relating to or connected to the Award Logo and the Cosmotrends Logo.
9.12    The Participant shall keep BFC fully harmless and indemnified against any and all direct or indirect damage, claim, losses, requests including requests for compensation for damages, actions or liabilities that BFC may suffer as a result of or in connection with the Participant's breach of this Article 9 and/or the breach of the intellectual property rights deriving from or connected to the Award Logo and the Cosmotrends Logo.
9.13    Upon termination, for any reason, of the license for the use of the Award Logo and the Cosmotrends Logo referred to in this article 9, the Participant undertakes to immediately cease any use of the Award Logo and the Cosmotrends Logo and to promptly remove the Award Logo and the Cosmotrends Logo and any reference to it from any and all its materials, means of communication, products, fittings and from any other and different vehicle. 
9.14    The Participant is in no way authorized to suggest or induce to think that its products or services are in partnership with or sponsored by or created in collaboration with BFC. The Participant undertakes not to engage in any misleading, illicit or immoral conduct that may be detrimental to the image and reputation of BFC and/or the Exhibition and/or the Award and/or Cosmotrends.

10.    License for the use of the materials and of the information provided by Participants

10.1    By sending images and materials relating to the products presented to the Award and Cosmotrends, each Participant grants BFC, Beautystreams INC and the Jurors the worldwide non-exclusive and royalty free license to use the said images and materials and the intellectual property rights and copyrights connected to and / or deriving from the said images and materials for the time necessary to carry out the Award and Cosmotrends, including the rights of vision, use, public display, broadcasting and republication on any media.
10.2    BFC, the Jurors and Beautystreams INC. shall use the images, materials and samples of the products sent by the Participants for the sole purpose and for the time strictly necessary to allow the Award and Cosmotrends to be performed.
10.3    The Participants are aware and accept that their application to the Award and Cosmotrends could be publicly revealed by BFC, therefore it is up to the Participants to obtain all intellectual property rights and take all appropriate measures to protect the rights of the Participants themselves. Neither BFC nor Beautystreams INC nor the Jurors can be held liable in any way for the publication, disclosure or infringement of intellectual property rights or copyrights or confidential information of the Participants. Neither BFC nor Beautystreams INC nor the Jurors are liable for any costs or expenses, including those relating to the protection of intellectual property rights and copyrights, which the Participants may incur as a consequence of participating to the Award and Cosmotrends.
10.4    The Participants declare and warrant that the submitted products for the Award and Cosmotrends comply with applicable law and the regulations in force such as, by way of example, the provisions on environment and safety of consumer products.
10.5    In the event of a dispute of any nature relating to the submitted products of a Participant to the Award and Cosmotrends, BFC reserves the right to disqualify from the Award and Cosmotrends the interested Participant or the single interested products. All decisions made by BFC are final, binding and unquestionable.
10.6    Participants grant and warrant: (a) that all information provided for the participation to the Award are true and that the submitted products and materials provided for the participation to the Award do not infringe in any way the rights of third parties, including intellectual property rights and copyrights; (b) to be in possession all the necessary rights and licenses required for the participation to the Award and for the fulfillment of the obligations contained in these T&C; (c) to be the owner or licensee of the copyright on the photographs and / or images provided for the participation to the Award; (d) that the license of use granted to BFC and the Jurors in relation to the images and materials relating to the products submitted to the Award does not infringe the rights of third parties. The Participants undertake to hold BFC, Beautystreams INC and the Jurors integrally harmless and indemnified against any loss, liability, litigation, direct or indirect damage, cost or expense arising to BFC, Beautystreams INC and / or the Jurors as a result of the breach of the guarantees referred to in letters a) to d) which precede.
10.7    If at the sole discretion of BFC the prohibitions and warranties contained in these T&C are deemed to be infringed, BFC reserves the right to disqualify from the Award the Participant or the single product concerned, to not publish the contents transmitted by the Participants or to remove all published content, as well as to disable, temporarily or permanently, the access to the Platform by the author of the said infringements.

11.    Provision of services connected to the Platform

11.1     Participants acknowledge and accept that the Platform or certain options relating thereto may be discontinued temporarily or permanently. BFC may also suspend at its own discretion the service, without being in any way obligated to notify or indemnify Participants. 
11.2     The Platform is an ever-evolving project and, therefore, Participants acknowledge and accept that the Platform is subject to modification, without BFC being in any way obligated to notify or indemnify Participants. 

12.    Deletion from the Platform of uploaded contents 

Each Participant is entitled to request BFC to delete from the Platform all or part of the uploaded contents; in this event, BFC and Jurors could be not able to vote, in whole or in part, the Participant and its products. In any case Participant shall not have the right to the refund of the application fee paid to attend the Award and Cosmotrends. 

13.    Platform’s moderation 

Contents received from Participants will be submitted to a pre-emptive check by BFC and, if compliant with the present T&C, they will be published. BFC reserves the right, at its own discretion, to not to publish and/or delete contents not compliant with the present T&C.

14.    Duration

These T&C are valid, effective and binding upon the Participants from their acceptance until the end of the Award ceremony, with the sole exception of article 9, in relation to the Award Logo and the Cosmotrend Logo’s license, and of the rights and obligations provided for by article10, whose effectiveness has a duration connected to the development and promotion of the Award and Cosmotrends.

15.    Modello d. lgs. 231/01 e Codice Etico di BFC

The Participant declares (i) to be aware of the contents of Legislative Decree no. 231/01 and subsequent amendments and additions, on the administrative liability of entities dependent on crime ("Legislative Decree 231/01"), (ii) to be aware of the fact that BFC has adopted an Organization, Management and Control Model in accordance with Legislative Decree 231/01 and, within the framework of this Organization Model,  management and control, a Code of Ethics, both of which can be consulted on the website https://www.cosmoprof.com/en/corporate/cosmoprof-network/organisational-management-and-control-model-231/and (iii) to accept the content of the Organisation, Management and Control Model pursuant to Legislative Decree 231/01 and the Code of Ethics, as an integral and substantial part of these T&C. The Participant undertakes to ensure that his/her personnel maintain, when participating in the Award, a conduct that complies with the provisions of Legislative Decree 231/01, the Organization, Management and Control Model and the Code of Ethics prepared by BFC, refraining from committing unlawful conduct or conduct that is otherwise incompatible with Legislative Decree 231/01,  the Organisation, Management and Control Model and the Code of Ethics. The breach by the Participant, or his/her staff, of the Organization, Management and Control Model adopted in accordance with Legislative Decree 231/01, or even of one of the provisions contained in the Code of Ethics, will entitle BFC to disqualify the Participant from the Award and Cosmotrends with immediate effect, without prejudice to the right of BFC itself to take action for compensation for any damage suffered or to be suffered.

16.    Applicable law and jurisdiction

The present T&C and conditions and the relationship between Participants and BFC shall be regulated exclusively by Italian law. Any dispute and or claim that may arise between Participants and BFC in connection to the performance and/or the interpretation of the present T&C shall be subject to the exclusively jurisdiction of the Court of Bologna (Italy).
